MHARR Statement on Marcia Fudge and on HUD Standards Implementation

HUD EXTENDS IMPLEMENTATION DATE FOR “THIRD SET” OF STANDARDS
As expected by MHARR, HUD has published a notice in the March 10, 2021 edition of the Federal Register copy attached, extending the implementation date for the so-called “Third Set” of manufactured housing standards revisions recommended by the statutory Manufactured Housing Consensus Committee (MHCC). The standards, published as a final rule on January 12, 2021, originally had an effective date of March 15, 2021. That deadline will now be extended 120 days, until July 12, 2021.
MHARR had previously noted that implementation of the new standards could be delayed, consistent with a “Regulatory Freeze” order entered by the Biden Administration upon assuming office in January 2021. According to HUD’s announcement of the implementation delay, the extension of the effective date for the new and revised standards is being provided in order to help manufacturers cope with supply chain delays attributable to COVID-19 pandemic disruptions, “modify processes to ensure compliance with the new regulation,” and consult, as necessary, with Design Approval Primary Inspection Agencies.
MHARR will continue to monitor this matter and will advise members of any further developments.
MARCIA FUDGE CONFIRMED AS HUD SECRETARY
On a closely related matter, former Representative Marcia Fudge (D-OH), also as expected, was confirmed as Secretary of the U.S. Department of Housing and Urban Development by the U.S. Senate on March 10, 2021, on a vote of 66-34.
As reported previously, MHARR has already communicated with the incoming Secretary, and looks forward to working with Secretary Fudge to finally achieve the full and proper implementation of the Manufactured Housing Improvement Act of 2000, as well as much-needed reforms to the Federal Housing Administration’s (FHA) manufactured home financing programs and Government National Mortgage Association (GNMA) restrictions that have gutted those programs.
