RE:                   COMPLIANCE DATE EXTENSION SEPTEMBER 16, 2024 FINAL RULE

            The U.S. Department of Housing and Urban Development (HUD), pursuant to a regulatory freeze Executive Order (EO) issued by President Trump on January 20, 2025, is delaying the implementation date for the so-called “fourth” and “fifth” sets of HUD Code standards changes recommended by the statutory Manufactured Housing Consensus Committee (MHCC) and published by HUD in the Federal Register as a final rule on September 16, 2024.

As originally published, the implementation date for the new standards was slated for March 17, 2025. However, in light of both the regulatory freeze EO and requests from manufacturers for “additional time to modify manufactured home floorplan designs and submit them through Design Approval Primary Inspection Agencies (DAPIA) review, revision, and approval process to ensure compliance with new or amended requirements before use in production,” HUD published a notice in the February 25, 2025 Federal Register (see, copy attached), extending the implementation date for the new standards until September 15, 2025.

While not necessarily likely, it should be noted that given the current regulatory environment in Washington, D.C., which is in a state of flux and transition, other changes to elements of the HUD manufactured housing regulatory program cannot be ruled out.

MHARR continues to closely monitor all aspects of the federal regulation of manufactured housing and will follow-up as warranted by events.
